Privacy Policy

QX LABS PTE. LTD. (referred to as “we”, “us”, or “our”) respects your data privacy and this Privacy Policy sets out how we may collect, use, disclose or otherwise process your personal data obtained during your access to our website and/or mobile app and associated software applications (collectively referred to as our “Platform”), and in the course of your use of all Products, information, functions, features and services provided by us through our Platform (collectively referred to as our “Services”). Please refer to the Terms of Use for the definition of “Products“.

This Privacy Policy applies to personal data in our possession or under our control, including personal data in the possession of organisations which we have engaged to collect, use, disclose or process personal data on our behalf and for our purposes. However, this Privacy Policy does not address content processed on behalf of customers of our business offerings, such as our application programming interfaces (“APIs”). The handling of such data is governed by our customer agreements. 

Personal data we collect from you

As used in this Privacy Policy, “personal data” is defined as data, whether true or not, about an individual who can be identified from that data, or from that data and other information to which we have or are likely to have access; or as set out in applicable data protection legislation in your jurisdiction. 

In certain situations, we may aggregate or de-identify personal data such that you can no longer be identified. Such de-identified information will be used to improve our Services (including to evaluate their effectiveness and add new features), to conduct research, and similar purposes. From time to time we may also analyse our general interactions with and the behaviour of our users and share aggregated information with third parties or make such aggregated information generally available. We may collect aggregated information as set out in this Privacy Policy, and will maintain and use de-identified information in such form. We will not attempt to re-identify the information unless required by law. 

We collect the following personal data in accordance with applicable local laws and, if required, upon obtaining your express consent: 

  • Account information. We collect personal data that you provide when registering for an account with us and/or logging in to our Platform. Such information includes the following:
    1. Identity and profile data, which may include your name, contact details, account credentials (i.e., username and password).
    2. Account and transaction data, including payment card details, bank account details, and transaction history.
  • Content, that is, personal data contained in the input, file uploads, or feedback that you submit to our Services. 
  • Marketing and communication information, which may include your interests, survey responses, marketing and communication preferences, as well as personal data contained in any messages you send to us, whether when providing feedback or engaging with us over email or chat. 
  • Social media information. We will collect personal data that you provide to us when interacting with our social media pages, such as your contact details. The companies that host our social media pages (which include Instagram, Meta, X, YouTube, and LinkedIn) may provide us with aggregate information and analytics, which may include information on your interactions with us on these platforms. 

We automatically collect and process certain types of personal data when you use your devices to access our Platform and use our Services, including the following: 

  • Usage data. This includes information about how and when you access and/or use the Platform and Services, such as types of content that you view or engage with, the features you use, and actions you take. We may also collect information concerning your location and time zone and the dates and times of access. 
  • Log data and device information. Your browser or device may automatically provide us with information when you use our Services, including your Internet Protocol address, browser type and settings, the date and time of your request, and information on how you interact with our Platform and Services. We may also collect information including the name of your device, and the operating system, device identifiers, and browser you use. 
  • Personal data collected through cookies: We or our authorised service providers may use cookies and similar technologies for analysis and evaluation to help us improve our Platform and/or Services, and your user experience. Cookies are small text files placed in the memory of your browser or device which allow us to recognise a particular device or browser.  

You can manage and delete cookies through your browser and device settings. However, please note that certain cookies are required to enable core functionality, and rejecting certain cookies may prevent you from using, or may negatively affect your use of, the Platform and/or our Services.

Use and Disclosure of your Personal Data 

We use and disclose personal data for the following purposes in accordance with applicable laws and, if required under applicable laws, upon obtaining your consent:

  1. To facilitate your access to the Platform and/or use of the Services; 
  2. To administer your account with us; 
  3. To conduct analytics, research, business and development, in order to enhance our Services, and develop new programs and services; 
  4. To communicate with you, including to provide information about our Services; 
  5. To send you marketing or promotional information; 
  6. To share personal data in order to execute any proposed business transfers, provided that we satisfy requirements under applicable data protection laws when disclosing your personal data; 
  7. To prevent fraud, criminal activities or misuse of our services, and to safeguard the security of our IT systems, architecture and networks; 
  8. To investigate any actual or suspected contraventions of our Terms of Use, this Privacy Policy or any of our policies, fraud, criminal activity or misuse of our services, whether relating to your use of our Services or any other matter arising from your relationship with us; 
  9. To perform due diligence; 
  10. To comply with legal obligations, legal processes, and to safeguard our rights, privacy, property, and / or those of our affiliates, you, or other third-parties; and 
  11. Any other purpose to which your consent has been obtained, in compliance with our obligations under applicable laws. 

Persons to whom we may disclose your personal data 

We may share, or permit the sharing of, your personal data and/or transfer your personal data to third parties and/or our affiliates for the above-mentioned purposes. These parties may be located in or outside of your jurisdiction and include, but are not limited to, the following: 

  1. Our affiliates, as relevant to the above mentioned purposes and to facilitate the operation of our business, though only to the extent necessary; 
  2. Service providers including third-party payment processors, payment service providers, providers of hosting services, customer service vendors, cloud service providers, email communication software providers, web analytics services, and other information technology providers, in order to fulfil contractual obligations; 
  3. Business account administrators
  4. Other users and third parties with whom you share information when using our Platform and Services
  5. Counterparties and other parties in the context of business asset transactions
  6. Our advisors, including accountants, auditors, lawyers, other professional advisors and business contacts for the purposes of assisting us to better manage, support or develop our operations and comply with our legal and regulatory obligations; 
  7. Law enforcement, government or regulatory bodies where required to do so in accordance with applicable laws, regulations, court orders, or legal process; 
  8. Any other party with your consent or at your direction; and 
  9. Any other party as permitted or required by applicable laws

International data transfers 

We may transfer, or permit the transfer, of your personal data outside of your jurisdiction for any of the purposes set out in this Privacy Policy, to the extent permissible under applicable laws. To comply with such applicable laws, we may inform and obtain your consent to such transfer and/or ensure that your personal data continues to receive a standard of protection that is at least comparable to that provided under your local data protection legislation. 

Security  

To safeguard your personal data from unauthorised access, collection, use, disclosure, copying, modification, disposal or similar risks, we have introduced appropriate administrative, physical and technical measures such as up-to-date antivirus protection, encryption and the use of privacy filters to secure all storage and transmission of personal data by us, and disclosing personal data both internally and to our authorised third party service providers and agents only on a need-to-know basis. However, note that no method of transmission over the Internet or method of electronic storage is completely secure. While security cannot be guaranteed, we strive to protect the security of your information and are constantly reviewing and enhancing our information security measures.

Retention 

We may retain your personal data for as long as it is necessary to fulfil the purposes for which they were collected, or as required or permitted by applicable laws. 

We will cease to retain your personal data, or remove the means by which the data can be associated with you, as soon as it is reasonable to assume that such retention no longer serves the purposes for which the personal data were collected, and are no longer necessary for legal or business purposes.

Data subject rights 

Depending on where you are located, you may have the following rights in relation to your personal data: 

  1. The right to access your personal data and information on how it is processed; 
  2. The right to delete your data personal data from our records; 
  3. The right to rectify or update your personal data; 
  4. The right to data portability; 
  5. The right to restrict or object to how we process your personal data; 
  6. The right to withdraw your consent, where we rely on consent as the legal basis for collecting or processing your personal data; 
  7. The right to lodge a complaint with your local data protection authority.

Children

If you are below 18 years of age, you must obtain permission from your parent or guardian prior to using our Services. 

Our Services are not intended for minors under the age of 13 and we do not knowingly collect the personal data of such persons. If you believe that a child under 13 has provided their personal data through our Services, please contact us at support@qxlabai.com.

External links 

Our Platform and Services may feature links to websites outside of our management or control, including social media platforms. Interactions on such external websites are not governed by this Privacy Policy and/or our Terms of Use and other applicable policies, and are instead governed by the policies made available by such third parties. The feature of these links on our Platform and/or Services also does not indicate our endorsement or review. 

Accuracy of personal data 

We generally rely on personal data provided by you or your authorised representative. To ensure that your personal data is current, complete and accurate, please update us if there are changes to your personal data by informing our Data Protection Officer in writing or via email at the contact details provided below.

Note that our Services may generate responses by making predictions based on user input. As such, there is a risk that generated output is not factually accurate, and we advise against relying on such generated output as a source. If you observe inaccuracies in generated output and wish to correct such inaccuracies, please submit a correction request to support@qxlabai.com. While we will endeavour to rectify such inaccuracies, please note that correction may not be feasible in every instance given technical limitations. You may also request the removal or deletion of your personal data from QX LABS PTE LTD business services  output using the email address support@qxlabai.com.
